A 6 year old child was hit by a car after allegedly darting into the street in front of the car. After being struck by the car, he suffered an open tibia fracture. The police report contained erroneous information regarding the grandmother having stated that the child was at fault for the accident for having darted in front of the moving vehicle. However, there was evidence suggesting that the driver was in fact at fault.

No depositions were taken and no mediator or jury were necessary to settle the case. We were able to obtain the defendant driver’s $50,000 insurance policy for the child.
