Who is Liable for Deaths and Injury in Fed Ex/ Bus crash

Tragedies like the one in Orland CA are hard to hear about let alone be directly impacted by such an event.  When a bus carrying school high school student on what was to be a happy trip in preparation for a bright future, was hit head-on by a Fed Ex big rig lives were changed forever. 10 people died in the fiery crash, 5 of them students, and more than 30 people were injured.

As a personal injury attorney my heart is broken for all of the family and friends of the victims of this terrible accident. I see first hand the toll of life changing accidents and injury.   Now that some time has passed, I am getting asked,

  • "Who is going to be held responsible for this crash"?
  • "Who is going to pay for the physical recovery of those who were injured"?  
  • "Who is going to compensate the families for the wrongful death of loved ones"?

The answer to these questions are not easy ones at this time.  The investigation in to the cause of this bus versus Fed Ex big rig accident will takes months, possibly a year.  Multiple agencies are working together to find the answers.  U.S. Safety Investigators and the NTSB will be looking at vehicle safety records and the drivers' safety history.  

Once it is determined what caused the accident, then liability will be clearer.  From a legal stand point, there is a possibility that there will be multiple defendants (responsible parties) in any Wrongful Death or Personal Injury cases.
